(USER AGREEMENT)

İnternet üzerinden www.daspieces.com (""Site"") üyeliği için sözleşme yapacağınız taraf Das Experiment Şehir Planlama Mimarlık Hiz. Ltd. Şti. (""Şirketimiz"")dir.

(Mersis No: 0270-1032-5000-0001). Şirketimiz İstanbul Ticaret Odası (İTO) üyesidir, ITO'nun meslek ile ilgili davranış kurallarını www.ito.org.tr veya 444 0 486 no.lu telefonundan öğrenebilirsiniz.

Bu üyelik sözleşmesinin kurulması için, istenilen Üye(lik) Bilgileri'ni ve tespit edeceğiniz şifreyi girmeniz, belirtilen onay ve/veya izinleri vererek [Üyeliği Tamamla] v.b. butonuna basmanız yeterlidir. İsim, elektronik posta adresi/cep telefonu no.su ve diğer zorunlu bilgileri doğru, eksiksiz ve hatasız girmenizi özellikle rica ederiz; bir hata fark ederseniz düzeltiniz. Üyelik işleminin tamamlanmasından sonra farkettiğiniz eksiklik/hataları ise Üye Girişi kısmından ulaşacağınız Hesabım bölümünde düzeltebilir veya  info@daspieces.com’a mail atabilirsiniz.

Üyelik işlemleriniz tamamlandığında bu Üyelik Bilgilendirmeleri-Sözleşmesi'ni (form-metin olarak) Üyelik Bilgileri'nde belirttiğiniz mail adresine göndereceğiz. Ayrıca Sitemizde yine form olarak yer almaktadır. Üyeye ""özel"" (taraf olarak bilgileri girilmiş) Sözleşme metni gibi bir metin Şirketimiz sistemlerinde ayrıca muhafaza edilmeyebilecektir.

Dilediğiniz her zaman yukarıda belirtilen iletişim kanallarından Şirketimize yapacağınız sözlü veya yazılı bildirim ile, hiçbir gerekçe göstermeksizin ve ceza ödemeksizin üyeliğinizi sona erdirebilirsiniz; aynı şekilde Şirketimiz de çeşitli nedenler ile üyelikleri sona erdirebilir/askıya alabilir.

Şirketimiz ve Sitemizde üye-müşteri bilgilerinin gizliliği, korunması, saklanması, işlenmesi-kullanımı ve imhası ile ticari elektronik iletişimler ve diğer hususlarda, aşağıda muhtelif cari esasları belirtilen Gizlilik Kuralları-Politikası ve Kullanım Şartları geçerlidir.

  • Üyeler tarafından verilen bilgilerin ve işlemlerin güvenliği için gerekli önlemler bilgi ve işlemin mahiyetine göre Şirketimiz veya ilgili kuruluşça sistemlerde ve internet altyapısında alınmıştır. Sitemizi kullanımlarınızda tüm kredi kartı işlemleri ve onayları Şirketimiz’ den bağımsız olarak ilgili Banka ve benzeri Kart Kuruluşlarınca online olarak aranızda gerçekleştirilmektedir (Kredi kartı ""şifresi"" gibi bilgiler Şirketimiz tarafından görülmez ve kaydedilmez).

  • Sitemize üyelik, ürün/hizmet satın alma ve bilgi güncelleme amaçlı girilen bilgiler, keza kredi kartı ve banka kartlarına ait hassas gizli bilgiler diğer internet kullanıcıları tarafından görüntülenemez.

  • Üyelerimize ait bilgiler yasal düzenlemelerin öngördüğü sorumluluklarımız çerçevesinde ilgili kuruluşlara açıklanabilir.

  • Üyelerimiz arzu ettikleri her zaman ve hiçbir gerekçe göstermeksizin; (yukarıda-aşağıda) belirtilen ilgili iletişim kanallarından Şirketimize ulaşarak veya iletilerimizde belirtilen red işlemini yaparak ya da varsa yetkili mercilerce kurulan/kurdurulan sistemi kullanarak, taraflarına ticari elektronik iletişimleri durdurabilirler. Üyenin bu husustaki açık bildirimine göre belirttiği kanallar için tarafına iletişimler yasal azami süre içinde durdurulur (yasalara göre mümkün-gereken işlem ve iletişimler her halükarda devam eder).

  • Üyelerimiz diledikleri zaman bilgisayar ve mobil cihazlarının işletim sistemi ve/veya internet tarayıcısı ayarlarından ""çerez""leri kaldırabilir ve/veya bildirimleri durdurabilirler.

  • Sitemizde yapacağınız bilgi güncelleme işlemleri ile herhangi bir bilgisini (iletişim bilgileri dahil) değiştiren üyelerimizin kişisel verileri ve elektronik ticari iletişim hususunda verdikleri izin değişen/yeni bilgileri için de geçerlidir. Bunun gibi iletişim tercihlerini değiştirerek herhangi bir iletişim kanalı-adresi için ticari elektronik iletişimi durduran veya ticari elektronik iletilerimizdeki ret işlemini yapan üyelerimiz, üyelik sayfasında iletişim istedikleri yönünde işlem yaptıklarında, ayrıca bir izin/onaylarına gerek olmaksızın ve varsa önceki ret bildirimleri dikkate alınmaksızın, burada ve sair suretle verdikleri onaya istinaden ve fakat yine sitemizdeki üyelik sayfasından iletişim tercihini değiştirene veya herhangi bir ticari iletişim için usulünce ret bildirimi yapana kadar, ilgili kanaldan ticari elektronik iletilerimizi almaya devam ederler.

Üyelik Bilgileri'nde istenen bilgilerini Sitemize girerek bu Sözleşmeyi onaylayan Üye; Site'mizde ve/veya mağazalarımızda kişisel veri işlemleri ve üyelik-müşteri hizmetleri hususunda yapılan bilgilendirmeleri önceden görmüş-incelemiş olmanın yansıra,

  • Bu Bilgilendirmelerde-Sözleşmede yazılı tüm bilgileri, şartları okuduğunu, anladığını, tarafına ait bütün yükümlülüklere eksiksiz ve zamanında uyacağını, keza ilgili hak ve sorumlulukları taşıyacağını, beyan ve kabul etmiş olur.

  • Sitemizden ulaşılan diğer sitelerde kendilerine ait gizlilik-güvenlik politikaları ve kullanım şartları geçerlidir; reklam, banner, içerik görmek veya başka herhangi bir amaç ile ulaşılan web sitelerinden, kendilerine gelen her türlü bildirimlerden ve mobil uygulamalardan bilgi kullanımları, keza sitelerin etik ilkeleri, gizlilik-güvenlik prensipleri, kişisel veri saklama ve imha politikaları, servis kalitesi, kullanım şartları ve diğer uygulamaları sebebi ile oluşabilecek ihtilaf, maddi-manevi zarar ve kayıplardan Şirketimiz sorumlu değildir.

  • Sitemiz ile ilgili her türlü bilgi ve içerik ile bunların düzenlenmesi, revizyonu ve kısmen/tamamen kullanımı konusunda; Şirketimizin anlaşmasına göre diğer üçüncü sahıslara ait olanlar hariç; tüm fikri-sınai haklar ve mülkiyet hakları Şirketimize aittir.

  • Üyelerin Sitemizden veya Sitemizde link verilen diğer sitelerden / mobil uygulamalardan / her türlü bildirimlerden edindikleri bilgiler, taraflarına elektronik iletişimi yapılan bilgilendirme, tanıtım ve reklamlar, keza her türlü öneriler çerçevesinde aldıkları kararlardan, bunlara göre yaptıkları her türlü işlem ve uygulama ile sonuçlarından üyeler sorumludurlar.

  • Üyelerin belirtilen suretler ile bilgilenmeleri ve/veya taraflarına yapılan iletişimler, bilgilendirmeler, bildirimler, tanıtım ve reklamlar neticesi bir ürün/hizmet satın alması söz konusu olursa anılan işlem ayrıca ve kanuni usulünce satıcı/sağlayıcı ile yapacakları tüketici sözleşmesine tabidir. Tüketici sözleşmesi kendi şartlarında ve tarafları arasında uygulanır. Sitemizden alışverişlerinizde, her işlem sırasında göreceğiniz sipariş ön bilgilendirme formu-mesafeli satış sözleşmesi şartları (da) geçerli olacaktır.

Şirketimiz yukarıdaki konularda ve üyelerine sunacağı ürün, hizmet ve fırsatlarda gerekli görebileceği her türlü değişikliği yapma hakkını saklı tutar; bu değişiklikler Şirketimizce Siteden/mobil uygulamasından veya diğer uygun yöntemler ile duyurulduğu andan itibaren geçerli olur; tüm kampanyalar duyurulan şartlarına tabidir.

Üyelerimizin haklı talep-şikayetleri ile her türlü başvurularını karşılamaktan memnuniyet duyarız. Mümkün olmadığı takdirde, kanuni parasal sınırlar dahilinde, yerleşim yerinizdeki İl ve İlçe Hakem Heyetleri ile Tüketici Mahkemeleri'ne başvurabilirsiniz.

Çerez Politikası

Das Pieces olarak; Site kullanımlarına ilişkin istatistiksel çalışmaların yapılması, hedeflenmiş reklam/tanıtımların yapılması ve etkin bir müşteri deneyimi yaşamanızı sağlamak amacıyla Mobil Uygulama ve Site’de muhtelif türde çerezler kullanılmaktadır. Bunlar oturum çerezleri, kalıcı çerezler, zorunlu çerezler, işlevsellik çerezleri, analiz çerezleri, ticari çerezler ve üçüncü parti çerezleridir.

Çerezler ziyaret edilen internet sitesinin düzgün bir şekilde çalışmasını ve geliştirilmesini, kullanıcı deneyiminin kişiselleştirilmesini ve iyileştirilmesini, siteleri oturum açmadan ziyaret edebilmesini ve/veya tarafına (duruma göre internet tarayıcı ve/veya ilgili mobil uygulama kapalı olsa dahi görebileceği) ticari-sosyal amaçlı bildirimler yollanmasını ve genel olarak site kullanıcıları-ziyaretçilerine gerek ilgili sitede, gerek başkalarına ait sitelerde (sosyal medya-ağlar ve online reklam ağları dahil) genel ya da özelleştirilmiş bilgilendirmeler, reklam ve tanıtımlar sunulmasını-iletilmesini sağlamak amacıyla bilgisayarlara ve mobil cihazlara yerleştirilen küçük veri parçacıklarıdır. Ayrıca, çerezler yoluyla elde ettiğimiz trafik verilerini dijital pazarlama amacıyla yurtiçindeki ve yurtdışındaki üçüncü kişi iş ortaklarımız ve dijital pazarlama firmaları ile paylaşmaktayız. Çerezler bilgisayar-cihazlarda, varsa kanuni azami süre aşılmamak kaydıyla, amaca uygun bir süre ile tutulurlar.

Sitemizi (mobil versiyonları dahil) kullanan Ziyaretçiler yukarıda belirtilen uygulamayı, keza ilgili tanımlama bilgilerinin burada, kişisel veri mevzuatında ve bu bilgilendirme metninin diğer kısımlarında çeşitli bilgileriniz için öngörülen amaçlarla ve kapsamda-şartlarda işlenmesini (bu çerçevede üçüncü kişilere aktarım-paylaşımları ve kullanmaları dahil) kabul etmiş sayılırlar.

Ziyaretçiler istedikleri her zaman cihazlarındaki program ve/veya işletim sistemi ve/veya internet tarayıcısının ayarlarından çerezleri düzenleyerek kaldırabilirler ve/veya anılan bildirimleri durdurabilirler (Bu takdirde Sitemizin/ilgili cihazın/programın arzu edildiği gibi çalışmayabileceği ve/veya bildirim içeriklerinden haberdar olunamayacağı bilinmelidir).

To establish this membership agreement, simply enter the required Member(ship) Information and a password you choose, give the specified approvals and/or consents and click on [Complete Membership] button etc. Please do enter your name, electronic mail address/mobile phone and other required information correctly, completely and accurately, and if you notice an error, please correct it. If you notice any missing/inaccurate information after you have completed the sign-up process, you can correct it in my account section via Member Login or send an e-mail to info@daspieces.com.

When you have completed your sign-up process, we will send this Membership Information - Agreement (as form-text) to the email address you have provided in the Membership Information. It is also available as a form on our Website. An Agreement text “”exclusive”” to a member (i.e. containing information of a specific member) may not be stored separately in our company systems.

You can terminate your membership at any time by oral or written notification to our Company through the communication channels mentioned above, without justification and without penalty, and Our Company may also terminate/suspend memberships for various reasons.

The following various current principles of the Privacy Rules-Policy and Terms of Use shall apply to the privacy, protection, storage, processing-use and destruction of member-customer information at Our Company and on our Website, as well as commercial electronic communications and other matters.

  • Our Company or the relevant organization has taken the necessary measures for the security of the information provided by the members and their transactions in their systems and Internet infrastructure based on the nature of the information and transaction. All credit card transactions and approvals are carried out online between you and the relevant Bank and similar Card Institutions independently of our Company while you are using our Website (information such as credit card ""PIN"" is not seen and stored by our Company).

  • The information entered on our Website for membership, purchase of products/services and information update, as well as sensitive confidential information related to credit and debit cards cannot be viewed by other Internet users.

  • The information of our members may be disclosed to the relevant organizations pursuant to our obligations under legal regulations.

  • Our members may stop receiving commercial electronic communications at any time and without justification by contacting our Company through the relevant communication channels provided (above-below) or by completing the rejection process specified in our messages or by using the system established by competent authorities, if any. Accordingly, communications to members will be ceased for the channels they expressly specify within the maximum legal period (transactions and communications that are allowed-required by laws shall continue).

  • Our members may remove the “”cookies” and/or stop receiving notifications at any time from the operating system and/or internet browser settings of their computers and mobile devices.

  • If you change any of your information (including contact information) using the information update procedure on our Website, the consent you have given for your personal data and electronic commercial communication shall also apply to the changed/new information. If a member that has changed their communication preferences to stop receiving commercial electronic communication for a communication channel-address or complete the rejection process in our messages makes a transaction on their membership page to request communications, that member shall continue to receive communications from the channel without a separate consent/approval and without regard to their previous rejection notice, if any, pursuant to the approval they have provided here or otherwise, until they change their communication preference again on their membership page on our website or duly send a rejection notice for any commercial communication.

A Member who has approved this Agreement by entering the requested information in the Membership Information on our Website represents and acknowledges that they have seen-reviewed the information provided on our Website (or mobile application) and/or at our stores regarding personal data transactions and membership-customer services, and

  • they have read and understood all the information and conditions written in these informational announcements-the Agreement, shall comply with all their obligations in a full and timely manner, and undertake the relevant rights and responsibilities.

  • Other websites accessed from our Website have their own privacy-security policies and terms of use; our Company shall not be responsible for any notification received from websites accessed to see an advertisement, content or for any other purpose, and for the use of information from mobile applications, as well as any dispute, material and moral damage and loss that may arise out of the ethical principles, privacy-security principles, personal data storage and destruction policies, service quality, terms of use and other practices of such websites.

  • All intellectual-industrial rights and property rights in any information and content related to our Website, and their arrangement, revision and partial/complete use belong to our Company, except for those owned by other third parties pursuant to an agreement with our Company.

  • Members are responsible for their decisions based on the information they obtain from our Website or other websites / mobile applications / notifications linked to our Website, and based on any information, promotion, advertisement and recommendation electronically communicated to them, as well as for any actions they take accordingly and their consequences.

  • If members purchase a product/service as a result of any information they obtain by any way described above and/or as a result of communications, information, notifications, promotions and advertisements provided to them, their purchase transaction shall be separately and legally subject to the consumer agreement they conclude with the relevant seller/provider. The consumer agreement shall be applied on its terms and between its respective parties. Each time you shop from our Website, the order preliminary information form-distance sales contract that you will see during each transaction shall also apply.

Our Company reserves the right to make any necessary changes to the above and to the products, services and opportunities it will offer to its members; these changes shall be effective from when they are announced by our Company on the Website/mobile application or by other appropriate methods; all campaigns shall be subject to the announced terms.

We will be happy to handle all kinds of legitimate claims-complaints and applications of our members. If that is not possible, you may apply to the Provincial and District Arbitral Tribunals and Consumer Courts in your area subject to the legal monetary limits.

As Das Pieces, we use various types of cookies on the Website in order to perform statistical work regarding the Mobile Application and Website usage, to make targeted advertisements/promotions and to ensure that you have an effective customer experience. These are session cookies, persistent cookies, mandatory cookies, functionality cookies, analysis cookies, commercial cookies and third-party cookies.
